LICENSE SUSPENSIONS


The Department of Motor Vehicles (DMV) or Motor Vehicle Services (MVS) tracks your driving behavior by adding points to your record when you are convicted of a Moving Violation in New Jersey. The more serious the violation, the more points you are assessed, which remain on your driving record for a period of time. Up to three points will be subtracted from your point total for every year of safe driving (no violations or suspensions). But your point total will never be reduced below zero.

Points are subtracted one year after:

  • your last point violation; or
  • your license was restored; or
  • the last time annual safe driving points were subtracted from your record (which ever is alter); or
  • After you complete an MVS driver improvement program, offered to problem drivers selected by MVS. Credit is given for a maximum of one program every two years.

Some traffic violations have more serious consequences then just receiving points. Some violations can include fines up to $1,500.00, loss of license up to 2 years, and jail time. More serious offenses can typically be downgraded to something much less serious. For example, if someone is Driving Without Liability Insurance (N.J.S.A. 39:6B-2) on their vehicle they are subject to a one year loss of license, however, our office can typically identify a defense so the charge will be downgraded to driving with an insurance document violation which has no loss of license and a small fine.


Driving with a Suspended License or Unlicensed Driver


Depending on the nature of the traffic violation and the defendant’s driving record, a judge and prosecutor could seek to suspend your driver’s license. If you have been charged with driving with a suspended license, whether it be because of a court-ordered suspension, or DMV imposed suspension, you could be faced with extended suspensions and even jail time. For example, if you are convicted of driving on the suspended or revoked list on more than one occasion, the court must sentence you to jail for a period of time. The period of incarceration will depend on the number of prior convictions. Enhanced penalties also apply to DWI.
